The Revenue Department of the Ministry of Finance of India onOctober 12, 2023issued a decision to continue to impose an anti - dumping duty on flax yarns of less than 70 denier or less than 42 counts originating in or imported from China for another 5 years.
I. Background
On February 7, 2018, Jaya Shree Textiles, a domestic company in India, first submitted an application to the Ministry of Commerce and Industry of India for an anti-dumping investigation on Chinese flax yarn. Several months later, on September 18, 2018, the Ministry of Commerce and Industry of India issued a final affirmative ruling on the case. This led the Indian Ministry of Finance to decide on October 18, 2018, to impose anti-dumping duties ranging from $0.50 to $4.83 per kilogram on the involved Chinese products, with the measure being effective for five years.
II. Sunset Review
As the expiration date of the anti - dumping measures approached, on March 31, 2023, Grasim Industries Limited (Jaya Shree Textiles) and Sintex Industries Ltd. in India submitted an application again, requesting the initiation of the first anti - dumping sunset review investigation on flax yarns of less than 70 denier originating in or imported from China. After several months of review, the Ministry of Commerce and Industry of India made a positive final ruling again on July 16, 2023.
III. New Anti - Dumping Duty Rates
According to the latest notification, India has decided to continue imposing anti-dumping duties on the involved Chinese products for a period of five years. The specific duty rates range from 2.29 to 4.83 USD per kilogram. Among them, the duty rate for manufacturers/exporters Jiangsu Jinyuan Flax Co., Ltd., Zhejiang Jinyuan Flax Co., Ltd., and Zhejiang Jinda Flax Co., Ltd. is 2.42 USD per kilogram, while that for Yixing Shunchang Linen Textile Co., Ltd. is 2.29 USD per kilogram. For all other Chinese manufacturers/exporters, the duty rate is 4.83 USD per kilogram.
This decision takes effect from the date of announcement, and the involved Indian customs codes are 530610 and 530620.
